I-601A Provisional Waivers
As of January 3, 2013, The Department of Homeland Security is giving family members of US citizens who have entered the United States unlawfully or without legal inspection to file for a provision allowing them to adjust their status in the United States. Effective as of h 4, 2013, these individuals can apply to maintain their green card and remain in the United States.
This provision was designed to allow family members to remain state side with their immediate family, and avoid familial separation for long amounts of time. Once their provision is approved by the USCIS, they can apply for their immigration visa in their home country.
